Excuse me if this comment is out of place, since I am an unregistered user and this topic has been abandoned for three months, but I felt that I had something to say about it. There's other way of publishing your idea rather than paying to Nintendo. However this new way involves making some changes.
I mean: Pokmon, Digimon, Monster Rancher, Medabots, etc, etc.... they all sound different, they all LOOK different, but yet there is still one escencial similarity between all of them:
RAISING CREATURES AND MAKE THEM FIGHT AGAINST OTHER CREATURES OF THE SAME KIND
Call them monsters, call them robots, or whatever you want. There's a similarity between all of them, but their owners don't fight for their copyright because of that.
What's my point? My point is that if you want to make something related to pokmon and then patent the idea without having trouble with Nintendo is very simple, although it requires sacrifices: CHANGE THE CONCEPT A LITTLE BIT
To be more specific, here there are some examples of what you can do:
- Forget about Nintendo's official pokmon (necessary)
- Change the creatures' name. For example, here there are some alternatives to POKEMON: Elemental Monsters, Elemental Animals, Battle Monsters, or Battlemon for short... or anything you can think about.
- Change the types. Call them elemental powers instead, or nature powers, or kinds, or something like that. Change GRASS for PLANT or FOREST, change GROUND for EARTH or DUST, change STEEL for METAL or IRON, and so on. Add new types or dispose old ones.
- Don't use similar items. Change POTION for another item with the same effect. Forget about STEEL COAT, NEVERMELTICE, etc, etc or at least change their names.
- Instead of catching the creatures with pokballs, try another item. For example, if you call your creatures "Battlemon" you could call the item BATTLETRAP, an make it look different, of course.
- Change GYMs for TRAINING CENTRES, for example.

The list goes on and on. These are just a few possibilities. Your imagination should give you other answers, maybe better ones.

At the end, you could come up with an idea different enough from pokmon to deserve its own copyright, and yet not so different to be considered something unrelated. I know it's hard, but it is not impossible.

This is only a piece of advice. You don't need to do what I say. I just thought that you should consider this ideas, if you ever want to do your own game or comic.
