The Trainer inserts the TM into a slot in the PokeDex and aims the Dex at the Pokemon. The Trainer then presses a button and the Pokemon learns it. A Pokemon doesn't even know what a TM is, let alone use it.

No, the same rules apply for both RPG's. There are no legendary pokemon except those introduced by the staff. Though it would be cool to be one of the legendaries, there are many other unique "regular" pokemon that you can be. I don't put a limit on the other kinds (except for level). Be a fish-pokemon out of water if you feel like it, but it would be a little restricting considering a fish can move very well outside of water.
